Risk Disclosure & Assumption of Risk
Version 2026-10-11 · Effective October 11, 2026
DRAFT. Have it reviewed by a Massachusetts attorney before relying on it.
1. Who we are
Count Like a Pro (the "Service"), including the website, web app, desktop app and mobile apps, is provided by JACOBEE, a business located in the Commonwealth of Massachusetts ("JACOBEE", "we", "us").
2. Education only, with no gambling and no advice
- The Service is educational and for entertainment. It does not offer, host, or take part in any real-money gambling, and you cannot win or lose money in the Service.
- Nothing in the Service is financial, investment, legal, tax, or professional advice, or a recommendation to gamble.
- Games, simulations, "expected value", "risk of ruin", bankroll and other figures are estimates from simplified mathematical models. They can be wrong and may not match real casino conditions.
3. No guarantee of results
- Card counting does not guarantee winnings. Even with perfect play, you can lose money, including over long periods, because of normal statistical variance ("luck").
- Your results depend on many things outside our control: casino rules, penetration, shuffling machines, table conditions, your own accuracy, fatigue and discipline, and how a casino treats you.
- Past results, examples, testimonials, simulations or practice scores do not predict future results.
4. Casinos, laws and your responsibility
- Laws and casino rules differ by country, state and venue. You alone are responsible for knowing and following every law and casino rule that applies to you.
- In many places, counting cards in your head is legal, but casinos are private businesses. They may refuse your bets, limit your play, shuffle more often, ask you to leave, ban you, or treat you as a trespasser if you return. (Some places, such as New Jersey, restrict excluding players for counting but still allow countermeasures.)
- Using any device, phone, app, or another person's help to count cards or gain an advantage at a casino table can be a crime in many places (for example, Nevada law prohibits devices used to count cards). Never use Count Like a Pro, or any device, inside a casino to help you play.
- We are not responsible for any ban, trespass warning, confiscation, legal action, loss of winnings, or any other action a casino, regulator or authority takes against you.
5. Age
You must be at least 21 years old, or the legal gambling age where you live if that is higher, to use the Service. Do not use the Service if gambling is illegal where you live.
6. Responsible gambling
- Only gamble with money you can truly afford to lose. Never borrow to gamble, and never chase losses.
- Set time and money limits before you play, and stop when you reach them.
- If gambling stops being fun, or causes problems with money, family, work or mood, stop and get help. In the US, call 1-800-GAMBLER (1-800-426-2537). In Massachusetts, you can also call the Massachusetts Problem Gambling Helpline at 1-800-327-5050. Help is free and confidential.
7. Assumption of risk and release
BY USING THE SERVICE, YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS CONNECTED WITH ANY GAMBLING OR CASINO ACTIVITY YOU CHOOSE TO TAKE PART IN, INCLUDING FINANCIAL LOSS, EXCLUSION OR BANNING BY CASINOS, AND LEGAL CONSEQUENCES. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE JACOBEE AND ITS OWNERS, EMPLOYEES, CONTRACTORS AND AGENTS FROM ALL CLAIMS, LOSSES AND DAMAGES ARISING FROM OR RELATED TO YOUR GAMBLING, YOUR WAGERS, YOUR RESULTS, OR ANY ACTION TAKEN AGAINST YOU BY A CASINO OR AUTHORITY, WHETHER OR NOT YOU FOLLOWED INFORMATION IN THE SERVICE.
This section is part of, and is governed by, the Terms of Use, including its limitation of liability and dispute-resolution sections.
